This AI and Data Use Policy applies to AI Features, Verkos AI, AI agents, computer-vision workflows, anomaly detection, summarization, report generation, natural-language interfaces, automation, and other AI-enabled Services provided by FlytBase.

This AI and Data Use Policy supplements the FlytBase SaaS Terms of Service (flytbase.com/legal/terms-of-service) and applies to AI-enabled features made available through FlytBase products and services.

1. What AI Features Do

AI Features may process video, images, telemetry, location data, sensor data, operational logs, prompts, text, annotations, tickets, alarms, VMS feeds, maps, models, and other Customer Data to generate detections, classifications, alerts, summaries, recommendations, reports, workflows, and other Outputs.

2. AI Outputs Are Probabilistic

AI Outputs may be incorrect, incomplete, delayed, duplicated, inconsistent, or unsuitable. Customer must independently review and validate Outputs before using them for safety, security, emergency response, flight operations, compliance, employment, legal, financial, or other significant decisions.

3. Human-in-the-Loop Requirement

Customer must maintain appropriate human oversight. Customer must not rely solely on AI Features to authorize flights, detect-and-avoid, dispatch emergency response, classify security threats, take adverse action against people, identify individuals, determine legal compliance, or make decisions that could materially affect safety, rights, or property.

4. Training and Improvement Controls

FlytBase may use data to improve the Services in the following ways:

  • (a) Always permitted: usage analytics, performance metrics, service logs, diagnostics, security logs, latency metrics, reliability metrics, and telemetry-derived operational statistics.
  • (b) Permitted if aggregated or de-identified: fleet reliability benchmarks, false-positive/false-negative analysis, model evaluation, route-planning benchmarks, alert-quality improvement, product analytics, and safety-performance analytics.
  • (c) Requires opt-in, Order Form permission, or DPA permission: identifiable raw video, imagery, audio, personal data, Sensitive Deployment Data, security footage, critical-infrastructure footage, customer-specific site imagery, or regulated data for training shared or general AI models.
  • (d) Customer-specific improvement: FlytBase may use Customer Data to configure, tune, troubleshoot, and improve Customer’s own deployment and models used only for Customer, subject to the Agreement and DPA.

5. Prohibited AI Uses

Customer must not use AI Features to:

  • (a) violate aviation, privacy, surveillance, cybersecurity, export-control, sanctions, or data-protection laws;
  • (b) identify or track individuals unlawfully;
  • (c) conduct facial recognition, biometric identification, or persistent individual tracking unless expressly permitted in writing and lawful;
  • (d) discriminate based on protected characteristics;
  • (e) make solely automated decisions with legal or similarly significant effects on individuals;
  • (f) support weapons development, unlawful targeting, or unlawful surveillance;
  • (g) generate deceptive, fraudulent, or misleading content;
  • (h) bypass safety systems, geofencing, command authority, audit logs, or access controls;
  • (i) infer sensitive personal attributes except where lawful and expressly permitted;
  • (j) upload data that Customer lacks rights, consents, permits, or lawful basis to process.

6. Customer Notices and Consents

Customer is responsible for all notices, consents, signage, policies, workforce notices, union notices, public notices, regulatory filings, data protection impact assessments, legitimate interest assessments, and other compliance steps required for cameras, drones, sensors, surveillance, geolocation, AI analytics, automated alerts, and data sharing.

7. Third-Party AI Providers

FlytBase may use third-party AI, cloud, infrastructure, and analytics providers to deliver AI Features. FlytBase will require service providers to protect Customer Data according to applicable contractual, security, and data-protection obligations. Customer Data sent to third-party providers will be governed by the Agreement, DPA, and applicable subprocessors list.

8. Model and Output Ownership

FlytBase owns its models, algorithms, prompts, pipelines, evaluation methods, agent frameworks, software, and AI systems. Customer owns Customer Content and Customer-specific Outputs, subject to FlytBase’s rights in the Services and the license granted under the Agreement.

9. Abuse Monitoring

FlytBase may monitor use of AI Features to detect abuse, security threats, safety risks, policy violations, and unlawful activity. FlytBase may suspend or restrict AI Features where necessary to protect FlytBase, Customer, third parties, aircraft, personnel, property, or the Services.
